1. About these Terms

These Terms of Use (Terms) apply when you access or use toucanchoose.com and any related comparison, filtering, shortlisting, account or referral features made available through the website (together, the Website).

The Website is operated by Codique Ltd, trading as ToucanChoose (ToucanChoose, we, us or our), a company registered in the United Kingdom under company number 10325352, with its registered office at 9 Clifton Avenue, Brymbo, Wrexham, LL11 5FS.

By using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

2. What ToucanChoose does

ToucanChoose provides a free online comparison and referral service. We bring together information about products and services offered by participating third-party providers so that users can browse, filter, shortlist and compare options in one place.

At launch, our main comparison category is broadband. We may add energy and other household or consumer service categories over time.

We aim to make comparison simpler and more useful, but we do not necessarily compare every provider, product or deal available in the market.

3. We are a referral site, not the service provider

ToucanChoose does not provide broadband, telecommunications, energy or any other product or service displayed on the Website. We are not the network operator, supplier, installer, reseller, broker or customer service provider for those products or services.

When you select Sign Up, Visit Provider or another outbound link, you will usually leave ToucanChoose and continue on the relevant provider’s website. Any application, purchase, switch or contract is made directly between you and that provider, subject to the provider’s own terms, eligibility rules, privacy notice and cancellation rights.

We are not a party to that contract and we are not responsible for delivering, installing, activating, billing, maintaining, repairing, cancelling or supporting the provider’s service. We cannot change or cancel a provider contract on your behalf.

4. Affiliate links, commissions and Awin

Some links on the Website are affiliate links. This means we may receive a commission if you click a tracked provider link and later complete a qualifying purchase, application or other action. ToucanChoose remains free for users to browse and compare.

Some of our affiliate relationships and links are administered or tracked through Awin, an affiliate marketing network that connects publishers such as comparison websites with advertisers and helps facilitate tracking, reporting and commission payments. Awin does not provide the broadband or other services shown on ToucanChoose and is not a party to your contract with a provider.

Commercial relationships may affect which providers or deals we are able to display. Commission rates can differ between providers. We will use reasonable efforts to make the commercial nature of affiliate links and any paid or promoted placement clear.

Prices and terms are set by the provider, not by ToucanChoose or Awin. You must confirm the final price, availability and full terms on the provider’s website before signing up.

5. The scope of our comparisons

ToucanChoose compares participating providers and does not claim to cover the whole market. A provider or deal may be absent because it does not participate in the relevant affiliate programme, has not supplied suitable or current data, is unavailable for your location, falls outside our current categories, or has not been selected for inclusion.

Search results may change according to your postcode, address, selected filters, package preferences, data availability and provider availability.

Words such as best, better, recommended or suitable should be understood in the context of the criteria, filters and information shown. They do not mean that a deal is objectively the best option for every person or that it is the lowest-priced deal anywhere in the market.

6. How we select and display providers and deals

We aim to feature established or relevant providers and offers that may be useful to our users. When deciding what to include, we may consider factors such as product relevance, market reputation, availability, range, value, data quality, customer information supplied to us, regulatory information where applicable, and whether a provider is available through our commercial or affiliate arrangements.

Our selection process is not an exhaustive audit, accreditation or guarantee. The inclusion of a provider or deal does not mean that we certify the provider, promise a particular service standard or guarantee that it will be suitable for you.

Where results have a default order, the factors used to produce that order should be explained on or near the results page. You may also be able to reorder or filter results by criteria such as provider, price, speed or package type. Clearly paid, sponsored or promoted positions will be labelled where applicable.

7. Prices, speeds, availability and other information

Monthly prices, setup fees, rewards, promotional periods, future price changes, contract lengths, estimated speeds, coverage, package features and eligibility conditions may change or may not apply to every address or customer.

The provider’s website and final order journey are the definitive source of the current offer. If information on ToucanChoose differs from the provider’s information, the provider’s current information will apply. 8. Your responsibility when choosing a deal

ToucanChoose gives you tools and information to help you compare, but the final choice is yours. Before signing up, you should review the provider’s full offer and consider the features that matter to you, including:

• contract length, minimum term and early termination charges;
• setup, activation, delivery or installation fees;
• scheduled price increases and what happens when any introductory period ends;
• estimated and guaranteed speeds, coverage and service availability at your address;
• usage limits, fair-use terms, equipment and included extras;
• eligibility, identity, address and credit-check requirements; and
• the provider’s cancellation, complaint, privacy and customer-support arrangements.

9. Eligibility and applications

The Website is intended primarily for users seeking services in the United Kingdom. You must be at least 18 years old to enter into a provider contract unless the provider expressly allows otherwise.

We do not guarantee that a particular deal is the cheapest, fastest, best, exclusive, most suitable or available option for you. We also do not guarantee that you will save a particular amount, be accepted by a provider, receive a reward or experience a specific speed or service level.

11. Accounts and saved comparisons

If the Website allows you to create an account, save comparisons or sign in, you must provide accurate information and keep your login details secure. You are responsible for activity carried out through your account unless it results from our failure to use reasonable care.

You must tell us promptly if you believe your account has been used without permission. We may suspend or close an account where we reasonably believe it is being misused, is insecure or breaches these Terms.

12. Acceptable use

You may use ToucanChoose only for lawful, personal comparison purposes. You must not:

• use the Website in a fraudulent, misleading, abusive or unlawful way;
• submit false information or impersonate another person;
• introduce malware, harmful code or material intended to disrupt the Website;
• attempt to gain unauthorised access to the Website, accounts, servers or data;
• scrape, harvest, copy or extract substantial amounts of data using automated tools without our written permission;
• reverse engineer or attempt to circumvent security, tracking, rate limits or technical restrictions; or

13. Intellectual property and provider brands

The Website, its design, text, graphics, software, comparison tools, databases and original content are owned by or licensed to ToucanChoose and are protected by intellectual property laws. You may view and use them for your personal, non-commercial comparison purposes only.

Provider names, logos, product names and trade marks belong to their respective owners. Their appearance on ToucanChoose is for identification and comparison and does not transfer any rights to you or to us.

14. Third-party websites

The Website contains links to provider websites and other third-party services that we do not control. A link does not make us responsible for the third party’s website, security, availability, accessibility, content, privacy practices, prices or performance.

You should read the third party’s terms and privacy information before submitting personal details or entering into a contract.

15. Privacy, cookies and affiliate tracking

We process personal information as described in our Privacy Policy. We use cookies and similar technologies as described in our Cookie Policy.

Your rights and remedies in relation to the supplied service are against the provider, subject to applicable law and the provider’s terms.

The Website is intended for domestic and private use. We are not responsible for business losses, including loss of profit, revenue, opportunity, goodwill or business interruption.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded. Nothing in these Terms affects your statutory rights as a consumer.

For a complaint about a provider’s application, contract, installation, bill, network, service, cancellation or customer support, you must contact the provider directly. ToucanChoose and Awin are not responsible for resolving a dispute under your provider contract, although we may correct inaccurate information on our Website where appropriate.

We may update these Terms to reflect changes to the Website, our business model, affiliate arrangements or the law. The latest version will be published on this page with the updated date.
